1) All hosting payments must be received in full on or before 5:00pm (CST) of the due date.
2) Current shared webhosting fee is $35 per month for basic 5 page website. Larger and/or custom websites will be notified if fee is more then $35 per month.
3) Returned Check Fee - $39. Regardless of the reason, any returned check will have the returned check fee added.
4) Late Fee - $30. If payment is not received on or before due date.
5) Re-Installment Fee - $95 per website. If payment is not received within 3 days of due date account will automatically be deleted and need to be reinstalled which will require up to 5 days after payment, late fee and reinstallment fee is received.
6) NO REFUNDS will be given on the website/blog design fee once a project is started. Monthly webhosting may be cancelled at anytime but NO REFUND will be given on unused portion of the month if cancelled.
7) Grace Period - NONE. There is NO GRACE PERIOD associated with any account for any service(s) provided. All payments are due by 5:00pm (CST) on the due date or before. Payments received after 5:00pm (CST) will post to your account on the next business day. Business days DO NOT include Saturdays, Sundays and/or Holidays.
8) You explicitly agree, in using this web site or any service provided, that you shall not:
- Provide any content or perform any conduct that may be unlawful, illegal, threatening, harmful, abusive, harassing, stalking, tortious, defamatory, libelous, vulgar, obscene, offensive, objectionable, pornographic, designed to or does interfere or interrupt this web site or any service provided, infected with a virus or other destructive or deleterious programming routine, give rise to civil or criminal liability, or which may violate an applicable local, national or international law
- Impersonate or misrepresent your association with any person or entity, or forge or otherwise seek to conceal or misrepresent the origin of any content provided by you
- Collect or harvest any data about other users
- Provide or use this web site and any content or service in any commercial manner or in any manner that would involve junk mail, spam, chain letters, pyramid schemes, or any other form of unauthorized advertising
- Provide any content that may be considered a violation of any local, national or international law, including but not limited to laws relating to copyright, trademark, or patents
- Representations made regarding products and services provided are governed by the policies and representations made by the person providing the product or service. We shall not be liable for or responsible in any manner for any of your dealings or interaction with others. WebsByWayne.com and/or Wayne Cook will not be liable or responsible for any content hosted on clients websites.
9) Service - Our web site and services provided to you on and through our web site on an "AS IS" basis. You agree that WebsByWayne.com/Wayne Cook exclusively reserve the right and may, at any time and without notice and any liability to you, modify or discontinue this web site and its services or delete the data you provide, whether temporarily or permanently. We shall have no responsibilty or liability for the timeliness, deletion, failure to store, inaccuracy, or improper delivery of any data or information.
10) Rights - We reserve all of our rights, including but not limited to any and all copyrights, trademarks and any other proprietary right that we may have in our web site, its content, and the services that may be provided. The use of our rights and property requires our prior written consent. We are not providing you with any implied or express licenses or rights by making services available to you and you will have no rights to make any commercial uses of our web site or service without our prior written consent.
11) Information, images and updates submitted for use on website/blog must be in usable form. Editing images, spellcheck, grammar check, formatting etc. will be billed at the current hourly rate of $15 per hour.
12) Hosting accounts do not include email accounts.
13) Branding - All webpages/blogs we create have our brand, ie; ( Webpage Designed and Hosted by: WebsByWayne ) at the bottom right above the copywrite information. If for any reason you want this brand removed there is a one-time $75 fee to remove this branding.
14) Updates/Site Maintenance - All updates and images are to be submitted via email ONLY. Updates to websites are usually done within hours of being received. However in some cases it may take up to 72 hours for updates to be completed. If there will be a delay of more then 72 hours you will be notified by email. We DO NOT accept cell phone text messages, clients will be billed $5.00 per text messages sent to our cell phone. We DO NOT do updates via the telephone, we work off site as much as on site and are not at the computer 24 hours a day.
15) Communications - Since this is a internet based service most communications are via email, it is the responsibilty of the client to make sure their account is updated with current contact information. We are not responsible or liable if you do not receive emails. It is always a good practice to "whitelist" or add the WebsByWayne.com domain to your address book and also verify that our emails are not going to your spam folder. Each ISP has different filters in place and each client has their computer setup differently. We verify all emails have left our server after which time we have no control over whether it reachs your email inbox.
16) Hosting terms may be updated at anytime it is the responsiblity of each client to review this page before placing orders or making payments to see if any changes have been made.
